Personal Injury Claims *

Our approach is to discuss the accident circumstances with the client, advise them on the merits of their case and clearly explain the procedure involved which may include dealing with insurance companies, processing the claim through the Injuries Board through to pursuing the matter through the Courts.

Enduring Powers of Attorney

An Enduring Power of Attorney is a legal document allowing a person to appoint an Attorney(s) to manage their personal and/or financial affairs in the event of that person losing their own mental capacity to do so. The document only takes effect when the person becomes of unsound mind and is then registered with the Ward of Courts Office.

To be registered, this office require confirmation from a Medical Practitioner that the person is no longer capable of managing their own affairs, for example they have suffered a stroke, a brain injury or have a degenerative disease such as dementia.

This is a very useful document to have in place as the alternative procedure involves the Ward of Court Office appointing a committee to manage the affairs of the incapacitated person. This is a longer and more expensive procedure. We can also advise of the creation of General Powers of Attorney and further capacity concerns.


Probate of Estates

We are in a position to deal with all aspects of the administration of an Estate including fully advising the Executor of the legal implications and duties of their post, realising the assets of the Deceased, advising beneficiaries of the taxation implications of their inheritance and arranging for payment of their tax liability with the Office of the Revenue Commissioners.

Depending on the nature and extent of the Deceased’s Estate, the Probate process can be a lengthy one. At Cullen & O’Beirne however, we aim to administer each Estate in the most efficient manner possible.

We also offer advice to beneficiaries of Estates and/or relatives of a Deceased who are uncertain as to their legal rights and entitlements under Succession Law.


Alternative Dispute Resolution and Mediation

The Principal of the firm, Barry O’Beirne, is an Accredited Mediator and offers mediation services to third party disputes. As opposed to taking a lengthy court action, mediation can assist in bringing about a speedier resolution to a dispute. In addition the client has and active role in the conclusion and resolution of the problem.
